Ltd. United Workers Union, which has also been\ncertified as Collective Bargaining Agent by the competent authority to deal\nwith the matters and grievances of the workers employed in the factory namely;\nInternational Foundation &amp; Garments (Pakistan) (Pvt.) Ltd. Situated on Plot\nNo. L-8, Block 22, Federal B Area, Karachi, served a notice of demand dated 1st\nJanuary, 2012 (received on 2nd January, 2012) under Section 42, IRA 2010, to\nthe said employer whereafter the management issued letter dated 3rd January,\n2012 for bilateral negotiations with the said C.B.A Union which was started on\n9th January, 2012 and the same continued upto 12th March 2012, whereby the\nrepresentatives of management and C.B.A Union discussed the matter from time to\ntime and with bilateral negotiation and consent of parties, the following\nsettlement has been arrived at this day 13th March, 2012:-\u003C\u002Fp>\n\n\u003Cp>NOW THIS SETTLEMENT WITHNESSTH AS FOLLOWS:\u003C\u002Fp>\n\n\u003Ch2>Demand No. 1\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>This demand pertains to increase in salary and allowance. The management has\nagreed to increase the same to all employees\u002Fworkmen who are in the employment\nof the company as per following category viz. (A) and (B).\u003C\u002Fp>\n\n\u003Cp>Category (A):\u003C\u002Fp>\n\n\u003Cp>Rs. 1500\u002F- p.m. to all the workers who were confirmed in service upto 31st\nDecember, 2005, and are still in the employment of the company. The said\nincrease would be allowed in the following manner: -\u003C\u002Fp>\n\n\u003Cp>(i) Rs. 860\u002F- increase per month in basic pay.\u003C\u002Fp>\n\n\u003Cp>(ii) Rs. 390\u002F- increase per month in house rent allowance.\u003C\u002Fp>\n\n\u003Cp>(iii) Rs. 250\u002F- increase per month in conveyance allowance.\u003C\u002Fp>\n\n\u003Cp>Category (B):\u003C\u002Fp>\n\n\u003Cp>Rs. 1250\u002F- p.m. to all the workers who were confirmed in service between 1st\nJanuary, 2006 to 31st December, 2011 and are still in the employment of the\ncompany. The said increase would be in the following manner: -\u003C\u002Fp>\n\n\u003Cp>(i) Rs. 690\u002F- increase per month in basic pay.\u003C\u002Fp>\n\n\u003Cp>(ii) Rs. 310\u002F- increase per month in house rent allowance.\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-COMMUTE_trigger\">\u003Cp>(iii) Rs. 250\u002F- increase per month in conveyance allowance.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch2>Demand Nos. 2,3,4,5 &amp; 6\u003C\u002Fh2>\n\n\u003Cp>The C.B.A Union has agreed to withdraw\u002Fdrop the aforesaid mentioned\ndemands.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 7\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>The management has agreed to increase the amount of Eidi on the eve of\nEid-ul-Fitre from Rs. 600\u002F- to Rs. 700\u002F- per person (workmen\u002Femployees) only\none time during the year.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>Demand No. 8,9 &amp; 10\u003C\u002Fh2>\n\n\u003Cp>The C.B.A Union has agreed to withdraw\u002Fdrop the aforesaid mentioned\ndemands.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 11\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-ONCERISE2_trigger\">\u003Cp>The management has been pleased to increase the amount for Annual Picnic\nfrom Rs. 90,000\u002F- to Rs. 100,000\u002F- once in a year in respect of\nemployees\u002Fworkmen employed in the factory.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>Demand Nos. 12,13,14,15,16,17 &amp; 18\u003C\u002Fh2>\n\n\u003Cp>The C.B.A Union has agreed to withdraw\u002Fdrop the aforesaid mentioned\ndemands.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 19\u003C\u002Fh2>\n\n\u003Cp>For aforementioned demand, the management has been pleased to revise and\nincrease with respect to production bonus rates for sewing operators\u002Fcheckers\nin Sewing Department and Packers in F\u002FG Department only as per Schedule-I,\nannexed herewith which is also part of this settlement.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 20\u003C\u002Fh2>\n\n\u003Cp>The C.B.A Union has agreed to drop the above demand.\u003C\u002Fp>\n\n\u003Cp>General\u003C\u002Fp>\n\n\u003Cp>a) In case the Federal or Provincial Government allows any increase in the\nwages\u002Fsalaries and\u002For allowances during the tenure of this settlement, the same\nshall be implemented in terms of the relevant law\u002Forder and\u002For notification as\nthe case may be.\u003C\u002Fp>\n\n\u003Cp>b) The Company and C.B.A Union have settled all the demands raised by the\nC.B.A Union vide their Charter of Demands dated 1st January, 2012 as mentioned\nhereinabove.\u003C\u002Fp>\n\n\u003Cp>c) The demands of the C.B.A Union which are not specifically agreed to in\nthis settlement shall be deemed to have been withdrawn for which the Union has\nagreed not to press the same in any manner whatsoever.\u003C\u002Fp>\n\n\u003Cp>d) All other terms and conditions and benefits presently enforced which are\nnot altered, changed and\u002For modified by this settlement will continue to be\nbinding as per existing and prevalent terms and conditions.\u003C\u002Fp>\n\n\u003Cp>e) The C.B.A Union and through it, all employees\u002Fworkmen employed and\nworking in the factory hereby undertake that they shall extend full cooperation\nto the management in maintaining the discipline, punctuality, daily attendance,\nindustrial peace, good order\u002Fconduct and also to increase production and to\nmaintain targets at their best and further try to increase the same so far as\npossible.\u003C\u002Fp>\n\n\u003Cp>f) The C.B.A Union also undertakes that in case the required\nproduction\u002Fstandards and\u002For the target is not maintained and achieved, the\nmanagement at its discretion to take appropriate action and to proceed and\ninitiate disciplinary action against whosoever would be involved in such matter\nwhich may also result in termination of their services in accordance with the\nprovisions of law.\u003C\u002Fp>\n\n\u003Cp>g) The C.B.A Union has also agreed to ensure punctuality in attendance and\nalso to avoid absentism or late comings by the employees\u002Fworkmen for which the\nmanagement may take appropriate action against them.\u003C\u002Fp>\n\n\u003Cp>h) The C.B.A Union has further undertaken not to raise or submit any\nDemand(s) to the management having financial implications\u002Fimpact or otherwise\nduring the currency of this settlement.\u003C\u002Fp>\n\n\u003Cp>i) The C.B.A Union has further agreed not to interfere in the acts of\nadministration. However, the office bearers of the Union may discuss with\nmanagement, such issue(s) concerning the employees\u002Fworkmen which needs to be\naddressed.\u003C\u002Fp>\n\n\u003Cp>PERIOD OF SETTLEMENT AND APPLICABILITY\u003C\u002Fp>\n\n\u003Cp>This settlement shall come into force with effect from 1st January, 2012 and\nshall continue for a period of two years, i.e. up to 31st December, 2013 and\nwill be applicable only to the permanent employees\u002Fworkmen presently working in\nInternational Foundation &amp; Garments (Pakistan) (Pvt.)
