AltafHussain - Treasurer\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>SHORT RECITAL OF THE CASE\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Atlas Engineering Workers Union (CBA) (hereinafter referred to as the\nCollective Bargaining Agent i.e. CBA\u002FUnion\u002FWorkers) served the Management of\nAtlas Engineering Limited (hereinafter referred to as the Company) Charter of\nDemands dated 25th MARCH 2013, under the Section -42(1) of IRA-2010 (Sindh),\ncopy of the same are attached hereto as Annexure-A.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>And, whereas the Management (hereinafter referred to as the Company) served\nthe CBA\u002FUnion of Atlas Engineering Workers Union (hereinafter referred to as\nthe CBA) Charter of Demands dated 27th MARCH 2013, under Section-42(1) of\nIRA-2010 (Sindh, which Charter of Demands in hereinafter referred to as\nAnnexure-B.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The Management\u002FCBA called meeting and several bilateral meetings were held\nfor discussions and negotiations of the Charter of Demands in order to come to\nan amicable Settlement\u002FAgreement on Demands submitted by both the Management\nand the CBA. In view of recurring rise in cost of living, the following\nAgreement\u002FSettlement has been reached in full and final settlement of all the\ndemands in the Charter of Demands of both the parties:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>1. BASIC PAY\u002FWAGES:\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>That with effect from 1st DECEMBER, 2012, the monthly wage of all the\npermanent workers, who were in the employment of the Company on 30TH\nNOVEMBER,2012, and thereafter continued to be in the employment of the Company\nup to the date of signing of this Settlement, shall be increased by Rs. 175.00\n(Rupees One Hundred Seventy Five Only) per month.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2. \u003C\u002Fh2>\n\n\u003Cp>The copy of revised Pay Scale is attached as Annex – C\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>3. HOUSE RENT ALLOWANCE:\u003C\u002Fh2>\n\n\u003Cp>That with effect from 1st DECEMBER, 2012, the existing rate of House Rent\nAllowance of Rs. 1,600.00 (Rupees One Thousand Six Hundred Only) per month of\nthose permanent workers will be increased by Rs. 300.00 (Rupees Three Hundred\nOnly) to make a total House Rent Allowance of Rs. 1,900.00 (Rupees One Thousand\nNine Hundred Only) per month as per present Rules.\u003C\u002Fp>\n\n\u003Ch2>4. WASHING ALLOWANCE:\u003C\u002Fh2>\n\n\u003Cp>That with effect from 1st DECEMBER, 2012, the Company will increase the\nexisting rate of Washing Allowance of Rs. 1050.00 (Rupees One Thousand Fifty\nOnly) per month payable to those permanent workers by Rs. 300.00 (Rupees Three\nHundred Only) per month to make a total washing allowance of Rs. 1,350.00\n(Rupees One Thousand Three Hundred Fifty Only) per month. Rest of the terms and\nconditions would remain unchanged.\u003C\u002Fp>\n\n\u003Ch2>5. CANTEEN ALLOWANCE:\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-MEALALL_trigger\">\u003Cp>a. That with effect from 1st DECEMBER, 2012, the Company will increase the\nexisting rate of Canteen Allowance of Rs. 1115.00 (Rupees One Thousand One\nHundred Fifteen Only) per month payable to each those permanent worker by Rs.\n300.00 (Rupees Three Hundred Fifteen Only) per month to make a total Canteen\nAllowance of Rs. 1415(Rupees One Thousand Four Hundred Fifteen Only) per month.\nRest of the terms and conditions would remain unchanged.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b. It is also agreed by the CBA that workers will contribute Rs. 200.00\n(Rupees Two Hundred Only) per month instead of Rs. 175\u002F= (Rupees One Hundred\nSeventy Five only) towards canteen expenses which already deducted from monthly\nsalary as agreed by CBA, w.e.f 1st September 2013.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>6. ALLWIN SPECIAL ALLOWANCE:\u003C\u002Fh2>\n\n\u003Cp>That with effect from 1st DECEMBER, 2012, the Company will increase the\nexisting rate of Allwin Special Allowance of Rs. 1,409.00 (Rupees One Thousand\nFour Hundred Nine Only) per month payable to those permanent worker by Rs.\n315.00 (Rupees Three Hundred Fifteen Only) per month to make a total Allwin\nSpecial Allowance of Rs. 1,724.00 Rupees One Thousand Seven Hundred Twenty Four\nOnly) per month. Rest of the terms and conditions would remain unchanged.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7. RECREATION ALLOWANCE:\u003C\u002Fh2>\n\n\u003Cp>That the existing rate of Recreation Allowance of Rs. 1,100.00 (Rupees One\nThousand One Hundred Only) per annum will be increased by Rs. 500.00 (Rupees\nFive Hundred Only), per annum to make a total Recreation Allowance of Rs.\n1,600.00 (Rupees One Thousand Six Hundred Only), per annum. The grant of this\nallowance will be given to those permanent workers only who have completed\none-year’s continuous service and will be subject to the condition that the\nworker who proceeds on approved annual leave, whether with or without pay, does\nnot extend his leave duration. In other words, if a worker over stays this\noriginally sanctioned leave period for any reason whatsoever, he will not be\neligible to receive this allowance.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>8. LONG SERVICE AWARD:\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-SENIOR_trigger\">\u003Cp>The Management agrees also to pay in Long Term Service Cash Award to the\nworkers on completion of 10, 15, 20, 25, 30, 35 &amp; 40 years of services\n(Sheet attached herewith as annex-D). All other terms &amp; conditions will\nremain same \u002F unchanged:\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>9. UMRAH:\u003C\u002Fh2>\n\n\u003Cp>That with effect from signing of this agreement, the Company will increase\nthe existing rate of UMRAH of Rs. 15,000.00 (Rupees Fifteen Thousand Only) to\nRs20,000.00 (Twenty Thousand Only). Rest of the terms and conditions would\nremain unchanged.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10. ATTENDANCE REWARD:\u003C\u002Fh2>\n\n\u003Cp>That with effect from 1st DECEMBER, 2012, the Company will increase the\nexisting rate of Annual Attendance Reward of Rs. 500.00 (Rupees Five Hundred\nOnly) to Rs1000.00 (One Thousand Only). Rest of the terms and conditions would\nremain unchanged.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>11. EX GRATIA UPON DEATH:\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-funeralpay\">\u003Cp>That in case of death of a permanent worker, company agrees to increase\nEx-Gratia upon Death by Rs. 3,000.00 (Rupees Three Thousand Only) which totally\ncomes to Rs. 15,000.00 ( Rupees Fifteen Thousand Only) as funeral expenses to\nthe widow\u002Flegal heirs of the deceased worker with effect from signing date of\nthis agreement. In case of death of wife of worker the amount for above\nmentioned purpose is increased from Rs. 8,000.00 (Rupees Eight Thousand Only).\ntoRs. 10,000.00 (Rupees Ten Thousand Only) Other terms &amp; conditions will\nremain same \u002F unchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>12. FINANCIAL ASSISTANCE FOR WIDOW:\u003C\u002Fh2>\n\n\u003Cp>That with effect from signing of this Agreement, the Company will increase\nthe existing rate of financial assistance for widow of Rs. 6,000.00 (Rupees Six\nThousand Only) per month payable to the widow of deceased permanent worker in\ncase of his death while in service with the company by Rs. 2,000.00 (Rupees Two\nThousand Only) per month to make a total financial assistance for widow of Rs.\n8,000.00 (Rupees Eight Thousand Only) per month. Rest of the terms and\nconditions would remain unchanged.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>13. WORKERS DAUGHTER MARRIAGE GIFT:\u003C\u002Fh2>\n\n\u003Cp>THAT with effect from signing of this Agreement, the Company agrees to\nincrease Worker Daughter Marriage Gift by Rs. 2000.00 (Rupees Two Thousand\nOnly) which totally comes to Rs. 7,000.00 (Rupees Seven Thousand Only). All\nother terms &amp; conditions remain unchanged.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>14. HEAT, HAZARDOUS &amp; NIGHT ALLOWANCE:\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-NOCTPREM_trigger\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-HARDSHIP_trigger\">\u003Cp>That with effect from 1st DECEMBER, 2012, the Company will increase the\nexisting rate of Heat , Hazardous &amp; Night Allowance by Rs2\u002F= (Rupee Two\nOnly) per attendance per Worker. Rest of the terms and conditions would remain\nunchanged.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch2>15. LONG TERM LOAN:\u003C\u002Fh2>\n\n\u003Cp>THAT with effect from signing of this agreement the Company agrees to pay\nFour Salaries for Loan. All other terms &amp; conditions remain unchanged.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>16. TRANSPORT \u002F BUS FACILITIES:\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-COMMUTE_trigger\">\u003Cp>That with effect from 1st DECEMBER, 2012, the Company will increase the\nexisting rate of Transport \u002F Bus compensation from Rs. 51.00 (Rupees Fifty One\nOnly) per attendance per worker (up \u002F down) to Rs. 57.00\u002F- (Rupees Fifty Seven\nOnly) per attendance per worker (up \u002F down) in lieu of providing transport This\ncompensation would not be included or part of any other calculations, allowance\nor gross wages. Rest of the terms and conditions would remain same \u002F\nunchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>17. PICNIC:\u003C\u002Fh2>\n\n\u003Cp>Under existing benefit the management agreed to enhance the picnic\nexpenditure by Rs. 10000.00 (Rupees Ten Thousand Only) from Rs40,000.00 (Rupees\nForty Thousand Only) to Rs. 50,000.00 (Rupees Fifty Thousand Only). Rest of the\nterms and conditions would remain same \u002F unchanged.\u003C\u002Fp>\n\n\u003Ch2>18. BONUSES:\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-ONCERISE_trigger\">\u003Cp>10-C BONUS \u002F STATUTORY BONUS:\u003C\u002Fp>\n\n\u003Cp>The Statutory Bonus, subject to provision of 10-C would be paid as per the\nlaw, on the basis of Company Annual profit (PBT), whenever declared so in the\naudited accounts of the Company.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>ANNUAL BONUS:\u003C\u002Fp>\n\n\u003Cp>Management agrees to pay Four Months &amp; Eight Days (4M+8D) Bonuses, on\nyearly basis on the following terms, for the financial years ending 30th June,\n2013 and 30th June, 2014.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>• BONUS will be calculated on the basis of and equivalent to Monthly Basic\npay as on 30TH JUNE of each financial year plus Statutory Cost of Living\nAllowance, if any, plus Compensatory Allowance to eligible workers, Company’s\nDearness Allowance but excluding all other Allowances, whatsoever and\u002For\nBonus(es)\u003C\u002Fp>\n\n\u003Cp>and\u002For earnings, howsoever termed.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>• ELIGIIBLE workers for the purpose of this Bonus will mean and include\nthose permanent workers only who will have completed one-year’s continuous\nservice in the Company on 30TH JUNE of each Financial Year.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>• ANY eligible worker who has absented himself from duty without\npermission\u002Fleave will not be entitled to Bonus proportionate to the number of\ndays he remained absent from duty in that Financial Year and the entitlement to\nthe Bonus shall stand adjusted.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>• THOSE permanent workers who will have less than one-year’s continuous\nservice on the 30TH JUNE, but have completed Ninety (90) days continuous\nservice on that year will be paid Bonus on pro-rate basis in each Financial\nYear.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>• TWO advance wages against bonus shall be paid to all permanent workers\nduring the month of Ramzan preferably in the First Week and two advance wages\npreferably in the First Four Days of Zil Hajj. Adjustment of advance wage shall\nbe as per the prevailing terms and conditions.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>THAT the CBA \u002F Workmen have agreed not to raise any further demand in\nrespect of Bonuses other than mentioned in this agreement.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>19. SHOP SUPERVISORS \u002F MONITORS:\u003C\u002Fh2>\n\n\u003Cp>That the company &amp; CBA agree that all those permanent workers who are\nassigned with supervisory \u002F monitory role (who do not have direct production\ntargets) amongst the permanent workers may be considered for the position of\npermanent supervisors in executive cadre under following criteria.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>• Period of Performance of duties as supervisor \u002F monitor not less than\none year.\u003C\u002Fp>\n\n\u003Cp>• Performance as Supervisor should not be less than “Excellent”.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The above mentioned workers who do not fulfill or come up to the criteria\nwould be liable to be reverted back to their respective work areas with\nindividual production targets &amp; removed from supervisory duties, with\neffect from signing of this agreement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>20. PRODUCTIVITY\u002FPRODUCTION:\u003C\u002Fh2>\n\n\u003Cp>The CBA Union agrees and undertakes that productivity shall be increased as\nper capacity of the machine from the date of this Settlement. The schedule of\ncapacity of production is annexed as Annex-E from pages No. 01 to 04. It is\nalso agreed that the benefits granted here in above under this settlement are\nsubject to the achievement of the requisite productivity \u002F productions.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>THAT the CBA has further agreed that the Standard, Quality, Quantum and rate\nof the production will be maintained at all times, whether in normal working\nhours and \u002F or during overtime.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>21. DISCIPLINE:\u003C\u002Fh2>\n\n\u003Cp>To maintain discipline within or around the factory premises is the entire\nprerogative of the Management and the CBA undertakes that it will neither\ncreate any obstacle nor interference by any means in exercise of the\nprerogative of the Management.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>22. UNION’S ACTIVITIES:\u003C\u002Fh2>\n\n\u003Cp>THE CBA\u002FUnion\u002F Workers undertake(s) not to indulge in Union’s activities\nof any kind, whatsoever during working hours and\u002For within the factory\npremises.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>CBA undertakes that the workers will strictly adhere to the factory timings\nand shall not early pack-up at the time of lunch and at the end of the shift.\nAnd shall also report to their duty place well in time even after the lunch\nbreak. The workers shall wear neat and clean uniforms and shoes and also\nobserve all safety measures, like wearing of goggles, gloves etc. during the\ncourse of duty which facility is fully provided by the Management.
