During\nthis period services may be terminated by either party giving seven (7) days\nnotice or pay in lieu of notice. After the probation period an employee shall\nbe automatically confirmed to permanent.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>3.PAYMENT OF WAGES\u003C\u002Fh3>\n\n\u003Cp>Employees shall be paid their wages on the last day of the month unless such\na day falls on a Sunday or Public Holiday in which case wages shall be paid on\nthe next working day.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>4.WORKING HOURS\u003C\u002Fh3>\n\n\u003Cdiv id=\"clause-SCHEDULE_trigger\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-schedulesrestpw\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-dayspweek\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-dayspweek_select\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-hourspweek\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-hourspweek_select\" class=\"cbaClause highlight\">\u003Cp>Working hours shall be 45 hours spread over six days of the week.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>5.OVERTIME ALLOWANCE\u003C\u002Fh3>\n\n\u003Cdiv id=\"clause-sundayallowanceperc1\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-sundayallowancetype\" class=\"cbaClause focus highlight\">\u003Cdiv id=\"clause-overtimeallowanceperc1\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-overtimeallowancetypeperiod\" class=\"cbaClause\">\u003Cdiv id=\"clause-overtimeallowancetype\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-OVERTIME_trigger\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-SUNDAY_trigger\" class=\"cbaClause highlight\">\u003Cp>Overtime shall be paid at the following rates for time worked in excess of\nthe working hours:-\u003C\u002Fp>\n\n\u003Cp>a) Normal overtime one and a half times the normal hourly rate\u003C\u002Fp>\n\n\u003Cp>b) Double for hours worked on Sundays and Gazetted Public Holidays\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-paidmaternityleaveduration\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-paidmaternityleave\" class=\"cbaClause highlight\">\u003Ch3>6.MATERNITY LEAVE\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-paidmaternityleavepay\">\u003Cp>Female employees shall be entitled to three (3) months maternity leave with\nfull pay provided that a woman who has taken three months maternity leave shall\nnot forfeit her annual leave in that year.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-paidpaternityleaveduration\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-paidpaternityleave\" class=\"cbaClause highlight\">\u003Ch3>7.PATERNITY LEAVE\u003C\u002Fh3>\n\n\u003Cp>A male employee shall be entitled to fourteen (14) days paternity leave.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-healthandsafetypolicy\" class=\"cbaClause highlight\">\u003Ch3>8.UNIFORM AND PROTECTIVE CLOTHING\u003C\u002Fh3>\n\n\u003Cp>Employees who are required by nature of their work to wear uniforms or\nprotective clothing shall be issued with (2) pairs of such uniforms or\nprotective clothing by the employer free of charge and shall be replaced after\n12 months.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-contractseverancepay1\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-contractseverancepay\" class=\"cbaClause highlight\">\u003Ch3>9.REDUNDANCY\u003C\u002Fh3>\n\n\u003Cp>The principal of last in first out shall apply taking into account also the\nfollowing factors :-\u003C\u002Fp>\n\n\u003Cp>(a) The employer shall decide on Education, performance, ability,\nreliability, competence and loyalty and the union will be informed.\u003C\u002Fp>\n\n\u003Cp>(b) Employees to be declared redundant shall be given a notice as per the\nClause of Termination of Service.\u003C\u002Fp>\n\n\u003Cp>(c) Employees declared redundant shall be entitled 15 days for each\ncompleted year of service.\u003C\u002Fp>\n\n\u003Cp>(d) Annual Leave or Prorate Leave and Leave Travelling Allowance shall be\npaid to the employees affected.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>10.EMPLOYEES PAYSLIPS\u003C\u002Fh3>\n\n\u003Cp>All unionisable employees will be issued with payslips.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>11.SUSPENSION\u003C\u002Fh3>\n\n\u003Cp>a. Employees who are suspended shall receive half of their wages during the\nperiod of suspension.\u003C\u002Fp>\n\n\u003Cp>b. Such suspension shall not exceed a period of one month.\u003C\u002Fp>\n\n\u003Cp>c. Employees who are found innocent after investigation are carried out\nshall be paid all the wage balances and continue with their work as normal.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>12.GRATUITY\u003C\u002Fh3>\n\n\u003Cp>Employees who are terminated normally shall be paid service gratuity 15 days\nper each completed year of service.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-pensionfund\" class=\"cbaClause highlight\">\u003Ch3>13.RETIREMENT\u003C\u002Fh3>\n\n\u003Cp>a. An employee may retire on either attaining the retirement age of sixty\n(60) years or on medical grounds.\u003C\u002Fp>\n\n\u003Cp>b. Retirement age shall be 60 years.\u003C\u002Fp>\n\n\u003Cp>c. Retirement on medical grounds shall be certified by a qualified medical\npractitioner.\u003C\u002Fp>\n\n\u003Cp>d. Employees who are retired on the above stated ground shall be entitled to\nretirement benefits as shown in Clause 12 (Clause on payment of service\ngratuity on retirement).\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>14.DEATH OF EMPLOYEE\u003C\u002Fh3>\n\n\u003Cdiv id=\"clause-funeralpay\" class=\"cbaClause highlight\">\u003Cp>In the event of an employee’s death, the employer shall give Kshs.10,000\u002F=\nto the next of kin.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>15.INJURY\u003C\u002Fh3>\n\n\u003Cdiv id=\"clause-disabilitypay\" class=\"cbaClause highlight\">\u003Cp>The conditions set out in the Work Injury Benefit Act, 2007 shall apply.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>16.CERTIFICATE OF SERVICE\u003C\u002Fh3>\n\n\u003Cp>This shall be issued as per the Employment Act, 2007.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>17.ANNUAL LEAVE\u003C\u002Fh3>\n\n\u003Cdiv id=\"clause-holidaysdays\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-PAIDLEAV_trigger\" class=\"cbaClause highlight\">\u003Cp>Annual Leave will be taken on completion of 12 months continuous service it\nshall consist of 22 working days.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>18.COMPASSIONATE LEAVE\u003C\u002Fh3>\n\n\u003Cdiv id=\"clause-childcareleave\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-childcare\" class=\"cbaClause highlight\">\u003Cp>An employee who desires to take leave on Compassionate grounds shall by\nprior arrangement with the employer be granted such leave upto seven (7) days\nwith full pay. These days shall be off – set from his\u002Fher Annual Leave.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>19.SAFARI ALLOWANCE\u003C\u002Fh3>\n\n\u003Cp>This is currently being taken care of by the employer.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>20.WARNING SYSTEM\u003C\u002Fh3>\n\n\u003Cp>An employee whose work or conduct is unsatisfactory or who commits a\nmisconduct which in the opinion of the employer doesn’t warrant instant\ndismissal shall be warned as per the Employment Act.\u003C\u002Fp>\n\n\u003Cp>I. The first and second warnings’ shall be entered in the Employees\nemployment record and the Shop steward of his Union shall be informed\naccordingly.\u003C\u002Fp>\n\n\u003Cp>II. The second warning shall be copied to the Branch Secretary of his\nUnion.\u003C\u002Fp>\n\n\u003Cp>III. If an employee who has already received two warnings commits a third\nmisconduct, he shall be liable to summary dismissal.\u003C\u002Fp>\n\n\u003Cp>IV.
