PREAMBLE\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-coverunion_trigger\">\u003Cp>The terms and conditions of employment set out in this Agreement shall be\nobserved by the parties to it, and shall apply to all employees covered by the\nRecognition Agreement signed between the parties and as covered by the\ndefinition given by the Union Registered Constitution.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>2. EMPLOYEES IN ACTING CAPACITY\u003C\u002Fh3>\n\n\u003Cp>An employee who is temporarily appointed or promoted to any acting capacity\nthat carries a higher rate of pay than the job in which he\u002Fshe is normally\nemployed shall receive the difference between such higher wage and his or her\nnormal rate and shall revert to his or her initial rate for the grade in which\nhe\u002Fshe is employed to work, provided that such employee had acted in that\ncapacity for a period not less than 7 days.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>3. CASUAL\u002FCONTRACT EMPLOYMENT\u003C\u002Fh3>\n\n\u003Cp>The company may employ a person on casual or contract terms for a period not\nexceeding three (3) months. A casual\u002Fcontract employee shall be paid at the\nappropriate daily rate which is not less than consolidated minimum wage.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>4. WORKING HOURS\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-schedulesrestpw\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-dayspweek_select\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-dayspweek\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-hourspweek\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-hourspweek_select\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-hourspday\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-hourspday_select\">\u003Cp>An employee shall normally be required to work, whether on shift or\notherwise, a total of 45 hours spread over 6 days per week, exclusive of meal\nbreak hours, provided that, such employee who is required to work in excess of\nsuch hours shall be paid for such excess hours at the appropriate rate as\nprovided by Clause 5 of this agreement.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>5. OVERTIME\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-OVERTIME_trigger\">\u003Cp>Overtime rates shall be as follows:-\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-overtimeallowanceperc1\">\u003Cp>a)For hours worked on week-days in excess of hours set out in Clause 4 –\ntime and a half.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-sundayallowanceperc1\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-SUNDAY_trigger\">\u003Cp>b)For hours worked on a rest day and gazetted public holidays- Double\ntime.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>6. GAZETTED PUBLIC HOLIDAYS\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-bankholidays1\">\u003Cp>An employee shall normally be granted leave with full pay on Gazetted public\nholidays provided that an employee who is required to work on such holidays\nshall be paid double rate as provided by Clause 5 above.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>7. ANNUAL PAID LEAVE\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-PAIDLEAV_trigger\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-holidaysdays\">\u003Cp>a) Employees shall be entitled to 24 working days annual leave.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>b) In the event of Gazette Public Holidays falling within the leave period\nsuch public holidays shall be added to the leave entitlement.\u003C\u002Fp>\n\n\u003Cp>c) The date of an employee’s leave shall normally fall after completion of\nevery 12 months service from his\u002F her date of engagement, but will be taken at\nthe convenience of the Company.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>8. COMPASSIONATE LEAVE AND LEAVE OF ABSENCE\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-childcare\">\u003Cp>An employee desirous of taking leave on compassionate grounds shall with\nprior arrangement with the company be granted such leave and shall subsequently\nbe set off against his\u002Fher annual leave. Such leave shall not unreasonably be\nrefused nor unnecessarily delayed and shall normally be paid.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>9. MATERNITY LEAVE\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-paidmaternityleaveduration\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-paidmaternityleave\">\u003Cp>A female employee shall be entitled to three months maternity leave with\nfull pay.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>a) A woman who has taken three months maternity leave shall not forfeit her\nannual leave in that year.\u003C\u002Fp>\n\n\u003Cp>b) Child-birth in respect of a woman employee shall not be deemed to be\nsickness.\u003C\u002Fp>\n\n\u003Cp>c) A female employee who takes maternity leave shall not incur any loss of\nprivileges during such period.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>10. PATERNITY LEAVE\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-paidpaternityleaveduration\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-paidpaternityleave\">\u003Cp>A male employee shall be entitled to 14 consecutive days paternity leave\nwith pay.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>11. SICK LEAVE\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-sicknessmaxdays\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-sicknessmaxdaysnr\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-sicknesspay\">\u003Cp>An employee who is unable to carry out his\u002F her duties by reason of sickness\nor injury falling without the provisions of the Work Injury Benefit Act 2007\nshall be entitled, in any period of twelve months to full pay for the first 35\ndays and a further 35 days on half pay subject to the production of a medical\ncertificate testifying the need of such absence. Sick leave with pay may be\nextended beyond the period stipulated above at the discretion of the\nCompany.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>12. INJURY BY ACCIDENT\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-disabilitypay\">\u003Cp>An employee who is injured in an accident arising out of, and in the course\nof his\u002Fher employment shall be entitled to compensation in accordance with the\nprovision of the Work Injury Benefit Act 2007.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>13. LETTERS OF APPOINTMENT\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-WAGES_determined\">\u003Cp>Letters of appointment will be given to all employees.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>14. CERTIFICATE OF SERVICE\u003C\u002Fh3>\n\n\u003Cp>On ceasing to be an employee of the Company an employee shall be issued with\na certificate of service which shall contain the following information,\nprovided that the Company shall reserve the right to withhold any information\nwhich it considers may prejudice the interests of either the Company or the\nemployee.\u003C\u002Fp>\n\n\u003Cp>a) The name of the employee\u003C\u002Fp>\n\n\u003Cp>b) Identity card no.\u003C\u002Fp>\n\n\u003Cp>c) The date when employment commenced\u003C\u002Fp>\n\n\u003Cp>d) Trade of occupation\u003C\u002Fp>\n\n\u003Cp>e) Date of termination of appointment.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>15. TERMINATION OF EMPLOYMENT- NOTICE\u003C\u002Fh3>\n\n\u003Cp>Except where an employee is summarily dismissed for gross misconduct or\nother lawful cause as prescribed in the Employment Act- 2007and provided the\nprobationary period has been completed, either party will be required to give 1\nmonth notice in writing or pay in lieu.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>16. WARNING PROCEDURE AND EMPLOYEE’S RESPONSIBILITIES\u003C\u002Fh3>\n\n\u003Cp>a) An employee who is guilty of an offence other than gross misconduct or\nother lawful cause of dismissal may be given a warning which shall be recorded\nin his\u002F her record card or history and which he\u002Fshe will be required to sign.\nThe signature or initial of an employee in history record card shall not mean\nthat employee plead guilty of the offence recorded against such employee, but\nsimply to confirm that has been recorded during employee’s presence or with\nhis\u002Fher full knowledge of such warning in accordance with the procedure laid\ndown by the recognition agreement between the Company and Union. An employee\nwho receives three such warning may be liable to summary dismissal if the\noffence or any other lawful cause of which he\u002Fshe seemed to be guilty is\nrepeated provided that all such warnings shall be invalid from history record\ncard of any employee after a period of twelve months from date of the last such\nwarning being given to the employee.\u003C\u002Fp>\n\n\u003Cp>b) All employees will adhere to the Government of Kenya laws as employee’s\nresponsibilities are greater than any other trade and ethics, the Kenya\nPharmacy and Poison Act, Good Manufacturing Practices and other legislation\nrelating to the manufacture of drugs has been observed strictly. In performing\ntheir duties, all employees are required to strictly adhere to the Good\nManufacturing Practices and Company practices and policies relating to the\nManufacture, packing, storage and handling of all company property including\nstocks, record, fixed assets etc and all employees are expected to be mindful\nof the well-being and welfare of the Company.\u003C\u002Fp>\n\n\u003Cp>c) All employees are required to be trained to create awareness on the\nCompany’s rules and Good Manufacturing Practices as well as any other\namendments to the same which may from time to time be issued by the Company.\nSuch rules and practices shall form the terms and conditions of appointment and\nemployment.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>17. PROBATION\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-contracttrialperiod\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-contracttrial\">\u003Cp>a) All employees shall be considered to be on probation for a period of\nthree months from the date of engagement which may be extended for a further\nperiod of up to six months by mutual agreement. During this period services may\nbe terminated by either party by giving 7 days notice or pay in-lieu\nthereof.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>b) An employee, who has successfully completed probation as from his\u002Fher\ndate of appointment by the Company, will be issued with a letter of\nconfirmation.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>18. DEFINITION OF EMPLOYEES\u003C\u002Fh3>\n\n\u003Cp>It is understood and agreed that the word “employees” in this agreement\nshall cover all employees regardless of sex unless specifically stated\notherwise.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>19. LEAVE TRAVELLING ALLOWANCE\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ANNLEAVE_trigger\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-annleaveallowanceamount1\">\u003Cp>During the validity of this agreement, an employee proceeding on authorized\nannual leave will be entitled to leave travel allowance as follows:-\u003C\u002Fp>\n\n\u003Cp>1st year – Kshs 3500\u002F-\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>2nd year – Kshs 4000\u002F-\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>20. UNIFORMS OVERALLS AND PROTECTIVE CLOTHING\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthandsafetypolicy\">\u003Cp>An employee who is required to wear uniform or overalls by nature of his\u002Fher\nwork or in accordance with the provisions of the Occupational safety and Health\nAct, 2007, shall be issued with two pairs of uniforms or overalls as well as a\npair of safety boots. The Company shall be responsible for laundering such\nuniforms, overalls and protective clothing and any other necessary personal\nprotective equipment.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>21. MEDICAL TREATMENT\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cp>The Company undertakes to pay the cost of such medical treatment and medical\nexpenses in accordance with the provisions prescribed by the Laws of Kenya\nrelative to employment of persons (Medical Treatment) Rules. The payment of\nmedical expenses will be made to all employees of the Company excluding their\nspouses and children, provided that such illness is that covered by the Act.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>22. REDUNDANCY\u003C\u002Fh3>\n\n\u003Cp>a) Definition\u003C\u002Fp>\n\n\u003Cp>“Redundancy” means the loss of employment, occupation, job or career by\ninvoluntary means through no fault of an employee involving termination of\nemployment at the initiative of the employer where the services of any employee\nare superfluous, and occupation and loss of employment due to Kenyanization of\na business.\u003C\u002Fp>\n\n\u003Cp>b) Alternative Employment\u003C\u002Fp>\n\n\u003Cp>In an effort to avoid redundancy, the Company will endeavour to arrange\nsuitable alternative employment within the Company. This employment may not be\nof the same grade. If the alternative employment is not acceptable to the\nemployee concerned, he\u002Fshe will be classified as redundant and, thereafter\neligible for the entitlement outlined in paragraph (f) of this Clause.\u003C\u002Fp>\n\n\u003Cp>c) Consultations\u003C\u002Fp>\n\n\u003Cp>In the event of redundancy, the Company undertakes to hold prior discussions\nwith the Union concerning the reasons for and the extent of the intended\nredundancy.\u003C\u002Fp>\n\n\u003Cp>d) Selection of Redundant employees\u003C\u002Fp>\n\n\u003Cp>In deciding which employee is to be declared redundant the Company will\nassess the relative merits, ability and reliability of the affected employees,\nbut when these factors are equal the discharge will be on the basis of\nseniority and membership or non-membership of the Union will not be a\nfactor.\u003C\u002Fp>\n\n\u003Cp>e) Re-engagement\u003C\u002Fp>\n\n\u003Cp>Redundant employees will be given prior consideration for re-engagement by\nthe Company should a vacancy arise according to their qualifications.\u003C\u002Fp>\n\n\u003Cp>f) Entitlement of Redundant Employees\u003C\u002Fp>\n\n\u003Cp>In the event of any employee being declared redundant, he\u002Fshe will be\nentitled to:-\u003C\u002Fp>\n\n\u003Cp>i. Normal notice or pay in lieu of notice as defined in this Agreement.\u003C\u002Fp>\n\n\u003Cp>ii. Payment of wages, overtime and any other remuneration which may be due\nto him calculated up to the date on which he\u002Fshe ceases work.\u003C\u002Fp>\n\n\u003Cp>iii. Pro-rata leaves in accordance with this Agreement.\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-contractseverancepay1\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-contractseverancepay\">\u003Cp>iv. Severance pay at the rate of 18 days for each completed year of\nservice.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>Provident Fund and other retirement benefits are in no way affected by these\narrangements.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>23. HOUSE ALLOWANCE\u003C\u002Fh3>\n\n\u003Cp>(All unionisable employees of the Company will get a house allowance of\nfifteen percent (15%) of one’s basic wage. This shall be incorporated in the\ngross pay.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>24. GENERAL WAGE INCREASE\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-wageincreaseperc1\">\u003Cp>The company undertakes to effect a general wage increase to all unionisable\nemployees .Employees earning salaries\u002Fwages above their respective grade rates\nas at time of signing this agreement shall also be a warded increment as\nfollows:-\u003C\u002Fp>\n\n\u003Cp>1. 1st year – 10 percent\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>2. 2nd year – 10.5 percent\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>25. FUNERAL EXPENSES\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-funeralpay\">\u003Cp>In case of death of an employee, the company shall contribute Kshs 30,000\u002F-\ntowards Funeral Expenses.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>26. TRANSPORT ALLOWANCE\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-COMMUTE_trigger\">\u003Cp>There shall be no transport allowance.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>27.
