Box 14662-00800 NAIROBI (Hereinafter\nreferred to as “the Company”) and KENYA NATIONAL PRIVATE SECURITY\nWORKERS’ UNION (Hereinafter referred to as the Union).\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Whereby the parties meeting together in free heart and voluntary association\nhave determined the terms and conditions of service which shall apply to\nemployees of the American Embassy Contract covered by this Agreement throughout\nKenya in occupational grades shown under Appendix A of this Agreement. This\nAgreement supersedes all terms and conditions of employment previously\napplicable to unionisable employees whether or not they become members of the\nUnion.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2.0 ENGAGEMENT\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-WAGES_determined\">\u003Cp>Every employee on engagement shall be given a letter of Appointment prior to\ncommencing duties and such letter shall bear the employee’s job title, salary\nand other related matters pertaining to the employee’s terms and conditions\nof service. Every new employee shall have access to a copy of the current CBA,\nstaff Rules and Company Policies through his\u002Fher Controlling Manager and Shop\nsteward.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>3.0 UNION SECURITY\u003C\u002Fh2>\n\n\u003Cp>All Security Officers and those hired in the future for all work done on\nAmerican Embassy Kenya shall on the 30th day following the beginning of their\nemployment, or the signing of this Agreement, whichever is later, be and remain\nmembers of the Union. New or temporary employees, shall be on probation for the\nperiod of two months. Thereafter, they shall be deemed regular employees, but\nshall be required to become members of the Union upon being hired. (if not a\nmember of the Union agency fee shall apply in accordance with section 49 of the\nLabour Relations Act 2007).\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>4.0 PROBATION AND CONFIRMATION\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-contracttrial\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-contracttrialperiod\">\u003Cp>The first two months of employment will be treated as probationary period\nand during that probationary period the contract may be terminable by either\nparty by seven days notice to be given by either party in writing or otherwise\nby the payment by either party in lieu of notice of not less than seven days’\nwages. Upon successful completion of probation the employee will be confirmed\nimmediately in writing.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>The first two months shall be treated as probationary period and during this\nperiod the contract may be terminated by either party giving 7 days Notice in\nwriting or payment of 7 days in lieu of such notice. Upon successful completion\nof probation the employee shall be confirmed in the appointment in writing.\u003C\u002Fp>\n\n\u003Cp>Probation periods maybe extended based on performance at the discretion of\nthe management.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>5.0 DEDUCTIONS OF UNION DUES\u003C\u002Fh2>\n\n\u003Cp>The deduction of the Trade Union dues shall be through the check-off system\nas governed by section 48 of the Labour Relations Act, 2007. All shall remit to\nthe Union Kshs. 300.00 per month and those above the rank of guards shall pay\nKshs.500.00 per month inclusive of COTU of dues Kshs. 100.00.per month.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>6.0 AGENCY FEES\u003C\u002Fh2>\n\n\u003Cp>The deduction of Agency fees in the implementation of the Collective\nBargaining Agreement shall be as stipulated in the Labour Relations Act, 2007,\nSection 49.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7.0 TERMINATION\u003C\u002Fh2>\n\n\u003Cp>It shall be a condition of every contract of employment that the contract\nshall be terminable by one month’s notice to be given by either party in\nwriting or otherwise by payment by either party in lieu of notice of one\nmonth’s salary.\u003C\u002Fp>\n\n\u003Ch2>8.0 SUMMARY DISMISSAL\u003C\u002Fh2>\n\n\u003Cp>An employee can be dismissed by the company on gross misconduct for reasons\ndefined in section 44 of the Employment Act 2007 Laws of Kenya, and as may be\namended from time to time. Section 41 of the Employment Act shall also be\napplicable.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>9.0 ANNUAL LEAVE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-PAIDLEAV_trigger\">\u003Cp>Employees will, after an initial period of 12 months’ services be entitled\nto 26 working days annual leave with pay. After completion of 12 month of\ncontinuous service with the company, an employee shall be entitled to 26\nworking days annual leave with full pay.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10.0 MATERNITY LEAVE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-maternityotherclause\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-paidmaternityleaveall\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-paidmaternityleaveduration\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-paidmaternityleave\">\u003Cp>A female employee shall be entitled to three months (3) Maternity leave with\nfull pay and shall not forfeit her annual leave for that year.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch2>11.0 PATERNITY LEAVE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-paidpaternityleaveduration\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-paidpaternityleave\">\u003Cp>A male employee shall be entitled to two weeks paternity leave with full pay\nadministered in accordance with Employment Act 2007.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>12.0 SICK LEAVE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-sicknessmaxdays\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-maxsicknesspay\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-sicknesspay\">\u003Cp>An employee will be allowed 2 months full pay then half pay on the third\nmonth in each year of service, provided that the employee produces a medical\ncertificate signed by a qualified\u002Fregistered medical practitioner. After two\nweeks of continuous service with the company, an employee shall be entitled to\nsick leave of two months with full pay and thereafter to a maximum of 15 days\nwith half pay in each period of 12 months provided that employee provides\nmedical certificate of incapacity from a qualified Medical practitioner or a\nperson acting on his behalf.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>13.0 COMPASSIONATE LEAVE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-childcare\">\u003Cp>1) An employee desiring to take leave on compassionate grounds shall by\nprior arrangement with the employer be granted that leave up to his earned\nleave entitlement and leave thus taken will subsequently be off set against his\nannual leave.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-childcareleave\">\u003Cp>2) Having exhausted his\u002Fher annual leave entitlement an employee may be\ngranted twenty (20) days compassionate leave without pay in any one year.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch2>14.0 GRIEVANCE HANDLING PROCEDURE\u003C\u002Fh2>\n\n\u003Cp>Grievance within the meaning of this provision shall include all complaints\nor disputes\u003C\u002Fp>\n\n\u003Cp>involving or arising between the parties (workers and employer) concerning\nthe\u003C\u002Fp>\n\n\u003Cp>Interpretation, application or alleged violation of any of the express items\nof this\u003C\u002Fp>\n\n\u003Cp>This Agreement shall be handled based on the Company’s grievance\nhandling\u003C\u002Fp>\n\n\u003Cp>procedure in conjunction with the Kenya Labour Laws.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>15.0 WORK INJURY\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-disabilitypay\">\u003Cp>In all cases involving injury sustained by an employee arising out of and in\nthe scope of his duty , the provisions of Work Injury Benefit Act, 2007 shall\napply.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>16.0 GRATUITY\u003C\u002Fh2>\n\n\u003Cp>(1). After five years ‘services with an employer, the employee shall be\nentitled to eighteen days pay for every completed year of service by way of\ngratuity based on the employee’s wage at the time of termination of\nservice.\u003C\u002Fp>\n\n\u003Cp>(2) An employee who is summarily dismissed for lawful cause or who\nterminates his services for any reason other than certified ill-health or\nretirement age shall not be entitled to a gratuity.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Provided that-\u003C\u002Fp>\n\n\u003Cp>(a) In the event of a dispute with regard to termination of services on\naccount of ill-health, the decision of a qualified medical practitioner on such\na dispute shall prevail.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(b) The normal retirement age shall be fifty –five (55) years. However\nindividual cases will be considered at the discretion of the management.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>17.0 UNIFORMS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthandsafetypolicy\">\u003Cp>Entitled employees shall be issued with uniforms as laid down in Appendix\n“B” which is attached hereto and forms part of this Agreement. The uniforms\nshall be issued annually except where expressly specified. All uniforms are the\nproperty of the company and must be returned when the employee leaves the\nCompany.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>18.0 REDUNDANCY\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-contractseverancepay\">\u003Cp>This shall be done in accordance with Section 40 of the Employment Act\n2007.\u003C\u002Fp>\n\n\u003Cp>Redundancy means loss of employment, occupation or career by involuntary\nmeans through no fault of employee involving termination of employment at the\ninitiative of the employer where the services of an employee or superous and\nthe practice commonly known as abolition of office, job, occupation and loss of\nemployment. All cases of Redundancy the company shall follow the Provisions of\nSection 40 of Labour Relations Act 2007.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>19. PUBLIC HOLIDAYS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-bankholidays1\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-OVERTIME_trigger\">\u003Cp>Employees shall normally be granted paid leave of absence on all gazetted\nholidays, but the Company reserves the right to require employees to work on\nthese days, where this is deemed necessary. The hours worked on these days\nshall be treated as overtime and paid as follows;\u003C\u002Fp>\n\n\u003Cp>Twice (2.0) the normal rate of wages per hour in respect of any time worked\non a gazetted public holiday and rest day.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>Formula for calculating overtime shall be\u003C\u002Fp>\n\n\u003Cp>Basic Salary X Overtime Worked X 1.5 divided by 225 hours per month\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>20. WORKING HOURS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-dayspweek_select\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-hourspweek_select\">\u003Cp>Working hours shall be fifty two spread over six days per week hours spread\nover five days a week. Any work done beyond this limit shall be treated as\novertime and compensated in accordance with regulations No. 7, 8, and 9 of the\nRegulations of wages of 1998 Private Security (Protective Security Services\nOrder) 1998.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>21. ACTING APPOINTMENT\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Where an employee is required to work for a period of NOT less than One\nmonth in occupation or grade for which the basic minimum wage prescribed under\nparagraph 3 is higher than the basic wage normally earned by the employee, he\nshall be paid an acting allowance at a rate not less than the difference\nbetween that higher basic minimum wage and his basic wage.\u003C\u002Fp>\n\n\u003Ch2>22. TRANSPORT ALLOWANCE WHILE ON TRAINING\u003C\u002Fh2>\n\n\u003Cp>Each employee who undergoes the normal training yearly shall be given\ntransport allowance of Kshs. 80.00 per day.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>21. TRANSFER ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>Where an employee is transferred to a branch of the employers business, or\nto a place either within or outside the District and the transfer results in\ndisturbance to housing arrangement, the cost of transporting the employee’s\npersonal and household effects, his wife and up to three children ( if living\nwith him) shall be borne by the employer.\u003C\u002Fp>\n\n\u003Cp>In addition to the amount payable under sub-paragraph (1) the employee shall\nbe paid One Hundred And Fifty (150.00) shillings per day for the first fifteen\ndays.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>23. DEATH OF AN EMPLOYEE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-funeralpay\">\u003Cp>In the event of death of an employee while in employment the employer shall\npay to the family of the deceased employee guard Kshs. 20,000.00 for the Coffin\nand Kshs.25, 000.00 for transportation of the body and belongings. Payment\nshall be made within three days of the employer being notified of death.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>24. TRANSPORT\u002FCOMMUTER ALLOWANCE PER MONTH.\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-COMMUTE_trigger\">\u003Cp>The Employer shall provide reasonable transport to and fro for all Guards\nengaged on this contract in both shifts (Day and Night).\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>25. BONUSES\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>All privileges such as bonuses which were previously enjoyed by the Guards\nshall remain in force. As per the Company policy and Contract.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>26. MEMBERSHIP\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is a condition that those charged with responsibilities which boarder on\nmanagerial duties shall automatically be considered as Managers and cease to be\nmembers of the Trade Union.\u003C\u002Fp>\n\n\u003Ch2>27. MEDICAL\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cp>The employer shall provide medical attention as stipulated in the Employment\nAct, 2007 Section 34 to all employees engaged in the US Embassy Project.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>28. DURATION\u003C\u002Fh2>\n\n\u003Cp>The duration of this Agreement shall be for (Two) 2 years and as long as the\ncontract with the US Embassy is in force.
