Productivity, flexibility, quality and cost are of\nparamount importance to the success of the business.\u003C\u002Fp>\n\n\u003Cp>The key task on which any Agreement needs to focus is 'the way in which\npeople are managed', to ensure that we deliver our commitment to the highest\nlevels of productivity, customer service and competitiveness. This will involve\nnew technology and methods of working, with strong team orientation and\nindividual responsibility and flexibility to change as appropriate. ASDA\ncommits to early consultation with USDAW on issues affecting colleagues (See\n“Scope of the Agreement\" below).\u003C\u002Fp>\n\n\u003Cp>It is accepted by both parties that there is a need to respond flexibly to\nchanges in demand for Asda's products and to avoid any action that interrupts\nthe continuity of service to our customers and employment. Supporting the\nimplementation of the most efficient methods of working, and changes to how\nwork is done, is a key part of this agreement whilst also recognising the joint\naims of work life balance, recognition of family life and social\nparticipation.\u003C\u002Fp>\n\n\u003Cp>This continues to be underpinned by both parties values.\u003C\u002Fp>\n\n\u003Cp> ASDA\u003C\u002Fp>\n\n\u003Cp>• We Care for our Customers, Every Day\u003C\u002Fp>\n\n\u003Cp>• We Care for our Colleagues, Every Day\u003C\u002Fp>\n\n\u003Cp>• We Strive to be the best we can be. Every Day\u003C\u002Fp>\n\n\u003Cp>USDAW\u003C\u002Fp>\n\n\u003Cp>To recruit, organise and represent workers within the ASDA business for the\npurpose of securing the best possible terms and conditions and providing\nsupport and protection at work.\u003C\u002Fp>\n\n\u003Cp>Within the agreement, which is not legally binding, ASDA recognises USDAW as\nthe sole representative union in Northern Ireland stores (excluding Living\nstores') ASDA acknowledges the Union’s right to represent colleagues who are\nUSDAW members along the lines set out in the agreement, the main purpose of\nwhich is to help meet the joint aims of improving performance, communication\nand engagement of all colleagues.\u003C\u002Fp>\n\n\u003Cp>The agreement will commence on the date both parties have signed this\ndocument and will continue until determined by 13 weeks' written notice,\noutlining reasons, by either ASDA or USDAW On receipt of this notice a joint\nmeeting of the signatories to the agreement should be convened with an aim to\nreach an amicable resolution and maintain the commitment to it. This Agreement\nsupersedes the recognition and procedure agreement dated February 2000\u003C\u002Fp>\n\n\u003Cp>Both ASDA and USDAW are fully committed to continuously improving the\nAgreement and to anticipating and resolving any differences in a way that\ncontributes to its success In this spirit, the Agreement will be reviewed\njointly to ensure that it is achieving the shared values and aspirations. This\nreview will be carried out jointly by the USDAW Area Organiser and the ASDA\nRetail People Manager on an annual basis Any changes would have to be jointly\nagreed by the USDAW Divisional Officer and the ASDA Industrial Relations\nDepartment\u003C\u002Fp>\n\n\u003Ch2>Scope of the Agreement\u003C\u002Fh2>\n\n\u003Cp>The Agreement will be concerned with establishing and improving\u003C\u002Fp>\n\n\u003Cp>Good people management\u003C\u002Fp>\n\n\u003Cp>■ Skills development - a commitment to equip colleagues within the scope\nof this Agreement with the basic skills and where appropriate a greater depth\nof skills in order to enhance job security\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-trainingprogrammes\">\u003Cp>• ASDA commits to develop an environment where all colleagues within the\nscope of this Agreement are aware of training and development opportunities and\nencouraged to embark on a program of skills enhancement\u003C\u002Fp>\n\n\u003Cp>Consultation ASDA commits to early, consultation on issues affecting\ncolleagues within the scope of this Agreement such as\u003C\u002Fp>\n\n\u003Cp>•Redeployment, redundancy, action short of redundancy and business\ntransfers\u003C\u002Fp>\n\n\u003Cp>•Awareness of training and development opportunities\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>•New policies and policy changes as appropriate Asda will take into\nconsideration the views of USDAW on behalf of the membership in terms of policy\nchanges and its implementation Such consultation will take place ahead of its\nimplementation.\u003C\u002Fp>\n\n\u003Ch2>Negotiation\u003C\u002Fh2>\n\n\u003Cp>This Agreement makes provision for collective bargaining between ASDA and\nUSDAW on pay related terms and conditions of employment (excluding pensions and\nother non- negotiable benefits such as bonus and colleague discount) and the\nprocedure for negotiations can be found at Appendix 5.\u003C\u002Fp>\n\n\u003Ch2>The ASDA way of working\u003C\u002Fh2>\n\n\u003Cp>ASDA commits to looking after all colleagues interests and the creation of\nan environment based on positive work outcomes for work performance and will be\nbased on the following key elements.\u003C\u002Fp>\n\n\u003Cp>• Sharing of information, ideas and proposals on diversity in the\nworkplace, pensions and family-friendly practices\u003C\u002Fp>\n\n\u003Cp>• Improving health &amp; safety at work for all colleagues\u003C\u002Fp>\n\n\u003Cp>Both ASDA and USDAW are committed to ensuring that the facilities for Shop\nStewards, including paid and unpaid time off for training and trade union\nduties, are appropriate to requirements. The agreed arrangements and facilities\nfor Shop Stewards are set out in the Appendices. ASDA and USDAW will review the\nfacilities for Shop Stewards on an annual basis and agree any proposed changes\nto these facilities\u003C\u002Fp>\n\n\u003Ch2>Colleague’s Right to Representation\u003C\u002Fh2>\n\n\u003Cp>ASDA recognises that colleagues have the right to collective and individual\nrepresentation.\u003C\u002Fp>\n\n\u003Cp>Colleagues have a right to join USDAW as the recognised union in ASDA stores\nin Northern Ireland. ASDA has a philosophy of open participation and this will\ninevitably lead to a mixed environment of union and non-union colleagues\nworking alongside each other. Colleagues will have the right to be represented\nby a Colleague Representative or a recognised Shop Steward at the Stores within\nthe scope of this Agreement.\u003C\u002Fp>\n\n\u003Ch2>Union Membership\u003C\u002Fh2>\n\n\u003Cp>ASDA will provide a check-off service to collect union fees through the\npayroll for USDAW Check off data is the sole accepted method of verifying\nmembership figures. Membership information will be reported to USDAW on a 4\nweekly basis.\u003C\u002Fp>\n\n\u003Cp>ASDA will provide a check-off service to collect union fees through the\npayroll for USDAW. USDAW will pay a sum of 5% for that service.\u003C\u002Fp>\n\n\u003Cp>Shop Stewards will be allowed reasonable time away from their work to\ndiscuss union membership with new starters after their induction. See Appendix\n3 for more information.\u003C\u002Fp>\n\n\u003Ch2>Consultation and Information Exchange\u003C\u002Fh2>\n\n\u003Cp>ASDA will continue to communicate and consult directly with colleagues and\nto listen to their views, opinions and suggestions ASDA will also consult with\nthe recognised Colleague Representatives and Shop Stewards through the\nColleague Circle, on matters of mutual interest, changes in working practises\nor new technology, and where legally required This committee will meet on a\nperiodic basis On occasions when it is appropriate to brief the Shop Steward\nindividually, this should be carried out before the Colleague Circle is\nbriefed\u003C\u002Fp>\n\n\u003Cp>Regular meetings will take place between the USDAW Area Organiser and ASDA's\nRetail People Manager.\u003C\u002Fp>\n\n\u003Ch2>Security of Employment\u003C\u002Fh2>\n\n\u003Cp>ASDA and USDAW recognise that in this competitive and dynamic environment it\nmay not be possible to maintain job and employment security at all times\ndespite the commitments and measures to bring about an environment of\nemployment security.\u003C\u002Fp>\n\n\u003Cp>Both ASDA and USDAW are committed to minimising the risk of redundancy and\nwill work towards the creation of a successful business to ensure ongoing\nemployment.\u003C\u002Fp>\n\n\u003Cp>We recognise that security of employment is of prime importance to all our\ncolleagues Where circumstances arise which could result in the redeployment or\nredundancy of colleagues, consultation will take place at the earliest\nopportunity.\u003C\u002Fp>\n\n\u003Cp>We will try to avoid redundancies by examining other options such as:\nretraining of colleagues affected by redundancy, the possibility of transfer to\nother work or another store, restrictions on overtime and recruitment,\nreallocation of hours of work across the store to provide the best solution for\nall concerned\u003C\u002Fp>\n\n\u003Cp>In the unfortunate event that we have to make a selection for redundancy, we\nwill take into account colleague skills, relevant experience, qualifications\nand assessment of their ability to meet future demands. In the event of taking\nthe above into account where colleagues are equal we would take attendance and\ndisciplinary records into account\u003C\u002Fp>\n\n\u003Cp>Colleagues for whom no suitable work is available in the company will be\ngiven time off to look for alternative employment Such time off will be granted\nwith pay and will not be unreasonably withheld\u003C\u002Fp>\n\n\u003Ch2>Grievance and Disciplinary Procedures\u003C\u002Fh2>\n\n\u003Cp>Where a grievance or disciplinary issue arises, the appropriate disciplinary\nand grievance procedure will be followed. The procedure is contained in the\nColleague Disciplinary and Grievance Booklet\u003C\u002Fp>\n\n\u003Ch2>Health &amp; Safety\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthandsafetypolicy\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthandsafetyprovisions\">\u003Cp>Health &amp; Safety is a real priority at store, and ASDA has a goal to\neliminate all accidents. We want to achieve industry-leading standards.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>ASDA’s responsibility is to provide a safe working environment for all\ncolleagues.\u003C\u002Fp>\n\n\u003Cp>The responsibility of our colleagues is to work safely at all times. Common\nsense will always have to be exercised; however, managers will always be on\nhand to offer colleagues advice and guidance on safety issues. Within the\nAgreement, ASDA and USDAW will jointly work towards improving the safety\nculture within stores covered by this Agreement.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-healthandsafetytraining\">\u003Cp>Colleagues will be provided with safety training to a level commensurate\nwith the job they are required to perform and which is pertinent to their place\nof work\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>Our Colleague Circles function as Safety Committees. In this instance the USDAW Area Organiser would contact\nthe ASDA Retail People Manager to discuss\u003C\u002Fp>\n\n\u003Cp>The Shop Stewards\u002FHealth and Safety Representatives will be recognised for 3\nyears after which all Shop Steward\u002FHealth and Safety Representatives will be\nsubject to re-election.\u003C\u002Fp>\n\n\u003Cp>Elections would normally be held in August each year with the term of office\nbeginning as of the 1st October in that year.\u003C\u002Fp>\n\n\u003Cp>Bi-Elections\u003C\u002Fp>\n\n\u003Cp>In the event that a Shop Steward\u002FHealth and Safety Representative resigns or\nleaves ASDA's employment and if the store meets the requirement to replace\nthem, then a bi-election will be called. (Annual Delegate Meeting) - 3 Shop Stewards would be elected to\nattend the USDAW annual conference. If there is a need for personal representations to\nbe made to the committee, then it will be mutually agreed by the Divisional\nOfficer and the Industrial Relations Team who will attend. In the event that\nthe committee is unable to agree, the company reserve the right to decide\nwhether a nominated colleague should be recognised as\u003C\u002Fp>\n\n\u003Cp>a shop steward.\u003C\u002Fp>\n\n\u003Cp>The Company must be able to offer reasonable evidence to support any view\nthat the colleague is unsuitable. This evidence will be based on either the\npersonal qualities and abilities, or the basic criteria for a Shop\nSteward\u002FHealth and Safety Representative\u003C\u002Fp>\n\n\u003Cp>Derecognising a Shop Steward\u002FHealth and Safety Representative\u003C\u002Fp>\n\n\u003Cp>From time to time there may be the requirement to review the ongoing\nrecognition of a Shop Steward, although it is believed that this would only be\nin very rare circumstances.\u003C\u002Fp>\n\n\u003Cp>The reason for this may include the following\u003C\u002Fp>\n\n\u003Cp>•The Shop Steward\u002FHealth and Safety Representative being issued with a\ndisciplinary warning for reasons that would damage his\u002Fher credibility in the\nrole - e g. serious misconduct\u003C\u002Fp>\n\n\u003Cp>•The Shop Steward\u002FHealth and Safety Representative continuously working\nagainst\u003C\u002Fp>\n\n\u003Cp>and outside the spirit of the Agreement - e.g. creating conflict situations\nrather than working collaboratively with managers and colleagues to find\nmutually acceptable solutions to issues.\u003C\u002Fp>\n\n\u003Cp>•The Shop Steward\u002FHealth and Safety Representative continuously fails to\ndemonstrate ASDA\u002FUSDAW values.\u003C\u002Fp>\n\n\u003Cp>•Loss of confidence in the Shop Steward from the store membership - this\nmatter would normally be raised through the USDAW Area Organiser\u003C\u002Fp>\n\n\u003Cp>•The procedure to follow to derecognise a Shop Steward would be the same\nas that detailed for unsuitable colleagues being nominated as Shop Stewards.\u003C\u002Fp>\n\n\u003Cp>Issuing Credentials\u003C\u002Fp>\n\n\u003Cp>When a new Shop Steward\u002FHealth and Safety Representative has been elected\nthe procedure for assuming their credentials will be as follows:-\u003C\u002Fp>\n\n\u003Cp>•The USDAW Area Organiser will write to the ASDA Retail People Manager\nconfirming the outcome of the election and seek credentials.\u003C\u002Fp>\n\n\u003Cp>•The ASDA Retail People Manager will respond in writing, granting\ncredentials subject to the election process outlined in this agreement. The\nletter will be copied to the General Store Manager, Industrial Relations\nDepartment and the colleague.\u003C\u002Fp>\n\n\u003Cp>Disciplinary Action with Shop Stewards\u003C\u002Fp>\n\n\u003Cp>If a Shop Steward is asked to attend a disciplinary hearing they will\ncontinue to have the right to be represented by the USDAW Area Organiser. The notice board will\nbe placed in an area where it will be seen and accessed by all colleagues.\u003C\u002Fp>\n\n\u003Cp>A copy of all USDAW's literature and pamphlets will have already been sent\nto and agreed by the ASDA Retail People Manager for display on the notice\nboards.\u003C\u002Fp>\n\n\u003Cp>• Only agreed USDAW literature can be displayed on the USDAW notice\nboard\u003C\u002Fp>\n\n\u003Cp>Shop Stewards may display local information on the USDAW notice board e.g\ninformation re a store meeting etc only after agreement with the store People\nService Manager\u003C\u002Fp>\n\n\u003Cp>Access to Telephones\u003C\u002Fp>\n\n\u003Cp>USDAW Shop Stewards will be granted access to the use of a telephone when\nthe subject of the call is relating to USDAW business in their own or a local\nstore. This facility will not be unreasonably withheld\u003C\u002Fp>\n\n\u003Cp>Secure Locker\u003C\u002Fp>\n\n\u003Cp>Due to the personal nature of the information and documentation the shop\nsteward should be provided with a secure locker for the storage of information.\nThis facility will not be unreasonably withheld.\u003C\u002Fp>\n\n\u003Cp>Meeting with Colleagues\u003C\u002Fp>\n\n\u003Cp>Where a Shop Steward is representing a colleague they should be given access\nto a private space to meet with the colleague in order to prepare for a meeting\nand where necessary and reasonably practicable access to the fax machine and\nphotocopier should be given. Shop Stewards will be given one weeks notice of induction sessions\nunless in exceptional circumstances where the induction is called at short\nnotice.\u003C\u002Fp>\n\n\u003Cp>•The People Service Manager and Shop Steward will at their Induction\ninform new colleagues that ASDA recognises and has an Agreement with USDAW\u003C\u002Fp>\n\n\u003Cp>•The Shop Steward will be present at the induction to introduce themselves\nto the colleagues and explain their role within the store\u003C\u002Fp>\n\n\u003Cp>•The Shop Steward will give each new colleague an information pack which\nincludes a jointly produced statement and the information to enable them to\njoin USDAW. should they so choose and answer any questions they may have\u003C\u002Fp>\n\n\u003Cp>•At the end of the induction the Shop Steward will be given any completed\njoining forms which will be processed in the normal way\u003C\u002Fp>\n\n\u003Cp>•If the Shop Steward is unavailable then a Shop Steward from a local ASDA\nstore can attend in their absence\u003C\u002Fp>\n\n\u003Cp>• Where a Shop Steward is unavailable the USDAW Area Organiser can attend\nin their absence\u003C\u002Fp>\n\n\u003Cp>•The USDAW session will be a minimum of 20 minutes\u003C\u002Fp>\n\n\u003Cp>The Shop Steward will be allowed reasonable time away from their work to\ndiscuss union membership with new starters at the end of their induction\u003C\u002Fp>\n\n\u003Cp>Best Welcome Tracking\u003C\u002Fp>\n\n\u003Cp>Each week, People Service Managers are to complete an E-Mail pro-forma for\nthe local USDAW office to establish any planned inductions, how many new\ncolleagues are expected to be attending and if the Shop Steward is available to\nattend. Where the Shop Steward is unable to attend then as outlined above a\nlocal Shop Steward would attend and in the absence of either the USDAW Area\nOrganiser would attend in their absence. The USDAW Area Organiser and Retail\nPeople Manager will complete a quarterly review of inductions that have taken\nplace\u003C\u002Fp>\n\n\u003Cp>Existing Stores - Established Colleagues\u003C\u002Fp>\n\n\u003Cp>Established colleagues who choose to join USDAW can do so by contacting\ntheir Shop Steward or the USDAW Regional Office\u003C\u002Fp>\n\n\u003Cp>As a member of the Colleague Circle the Shop Steward’s photograph and name\ncan be displayed on the Colleague Circle Board.\u003C\u002Fp>\n\n\u003Cp>New Stores\u003C\u002Fp>\n\n\u003Cp>•When details of new stores are able to be discussed, the Retail People\nManager will contact the USDAW Area Organiser to discuss access\narrangements.\u003C\u002Fp>\n\n\u003Cp>•Access arrangements will be the same as outlined above under Existing\nstores - New Starters.\u003C\u002Fp>\n\n\u003Cp>Admin Process for Setting up Membership and Reporting\u003C\u002Fp>\n\n\u003Cp>When a colleague completes a membership request form provided by the People\nService Manager or USDAW Shop Steward either at their induction or at any other\ntime they should return it to the People Team in store.\u003C\u002Fp>\n\n\u003Cp>On receipt of the form the People Team should complete the colleagues data\non the form e.g. Wal Mart number and enter it on to the People Soft System\nindicating that the colleague wishes to join USDAW and have their subscriptions\ntaken from their pay.
