The case was brought by a member of the HK union, who challenged the long-standing practice whereby part-time workers do not receive overtime pay for additional hours worked unless they exceed full-time working hours. The court found that this practice can constitute unequal treatment. The worker had been employed on a part-time contract but regularly worked beyond his agreed hours without receiving overtime compensation.
