Netherlands - Court rules that bogus self-employed are agency workers - June 30, 2026
The Amsterdam Court of Appeal has ruled that workers using Temper’s online platform are temporary agency workers rather than self-employed workers. The landmark ruling overturns an earlier lower court decision in 2024, which ruled that Temper is an online platform for own-account workers and not an employment agency. The case was brought on by FNV and CNV unions. The unions argued that in recent years, Temper has utilised unfair competition in its business model by employing bogus self-employed workers. Union FNV called the decision a “wonderful victory” for the unions and the workers who were employed as self-employed professionals.
