Denmark - Part-time workers’ back-pay claims limited to five years - September 30, 2026

An industrial arbitration ruling of 4 September settled how far back part-time workers can claim overtime pay. In February 2026, arbitration rulings found that under the EU Part-time Work Directive, part-time workers can be entitled to overtime pay for hours beyond their contracted hours, even if they have not exceeded the full-time norm. That left open whether back-pay claims could go back five or ten years. The new ruling states that such claims fall under the general five-year limitation period for wage claims, calculated separately for each pay period.
